Privacy Policy

This privacy policy (the “Privacy Policy”) applies to your use of the website dmitrib.com, which is owned and operated by the Clarity Communications Inc. (“Clarity Communications”, “us”, “our” or “we”). In addition, this policy applies to all Clarity Communications email listserves. Your privacy and security are important to us. Please read this Privacy Policy carefully to understand how we will use and protect the personal information you provide us. We will not share your personal information with anyone except as described in this Privacy Policy. We do reserve the right to make changes to this Privacy Policy from time to time, so please check back periodically. 

 

WHAT INFORMATION WE COLLECT FROM YOU.

Personal Information vs. Non Personal Information. The Websites collect two types of information about you, Personal Information and Non Personal Information. “Personal Information” refers to information that lets us know the specifics of who you are and which can be used to identify, contact or locate you. We may also collect and process Personal Information to verify your identity in connection with your use of the Websites. Examples of Personal Information include, but are not limited to, your first name together with your last name, your credit card number for payments or donations, your mailing address and/or email address, and your phone number. Generally, we collect Personal Information when you use the Websites, become a registered user or otherwise volunteer information about yourself. “Non Personal Information” refers to information that does not by itself identify you or a specific individual. Examples of Non Personal Information we may collect include, but are not limited to, demographic information and which web pages of ours are most often visited. We may collect Non Personal Information through registration as discussed above as well as automatically through use of industry standard technologies discussed further below.

Information You Provide To Us. You will have the opportunity to provide us with Personal Information and Non Personal Information which we will collect directly from you as follows:

a) For Members. To use certain portions of the Websites, users will be required to register with the Websites. To complete the registration process, we require that each Member provide certain data, which must include a user name, password, email address, the user’s first and last names, and city, and may include phone numbers, addresses, age, birth date, and occupation (collectively, the “Member Profile”). We also may collect additional information in connection with your registration, including but not limited to the referring URL and IP address. Users are responsible for maintaining the truth, accuracy, currency and completeness of their Member Profile.

b) For Prospective Members. For visitors looking for information about our products and services, we collect Personal Information such as name, email, geographical location, phone number, and some information about interests in the organization. For visitors who register to participate in programs or workshops (“Prospective Members”), we collect your first and last name, address, age, date of birth, phone number, and an email address. We also may collect additional information in connection with your registration, including but not limited to the referring URL and IP address.

c) For Visitors. For visitors who provide comments, ideas, photographs, stories, testimonials or other feedback about our Websites, or provide us any other information via correspondence or otherwise (collectively, “Feedback”) directly via email hyperlink on the Websites, we collect your first and last name, email address, phone number (if provided) and any Feedback included in the email. By submitting Feedback, you agree that we may use your Personal Information and such Feedback as permitted under this Privacy Policy, including reproducing the Feedback on the Websites and in our marketing and advertising materials.

d) Donations or Online Payments. If you submit any online donations or purchase any products or services available through the Websites, you will be required to provide financial information, such as your credit card number and expiration date. This information is used for billing purposes and to fulfill your donation or order. Clarity Communications does not store or process personal financial information for transactions, but uses secure payment processing gateways. If we have trouble processing a payment submitted via the Websites, we will use your Personal Information to get in touch with you. To properly process your credit card information, we must share your personal and financial information with the merchant bank for authorization and approval.

e) Public Communications Features. From time to time you may be able to participate in certain activities on the Websites, such as posting reviews and user opinions, and participating in user forms, chat rooms and/or bulletin boards which give you the opportunity to communicate or share information not just with us but with other users of the Websites (altogether, “Public Communications Features”). Be aware that when you volunteer information or create a public profile in the course of your participation in our Public Communications Features, you are also agreeing to allow certain aspects of your Personal Information to be made public. This includes your username and any Personal Information or images that you add to your signature, or that you include in any upload or posting by you when using such Public Communications Features. You acknowledge and agree that Clarity Communications does not review, censor, or in any manner control the content of these Public Communications Features. Consequently, Clarity Communications has no liability or responsibility for information made available through these Public Communications Features and you will be liable to us for any liability that we incur as a result of any information submitted by you in or through the Public Communications Features.

Information Collected Through Technology. We or our third party service providers may collect information from visitors or registered users regarding the referring URL, your IP address, which browser you used to come to the Websites, information regarding your domain server, the country, state and telephone area code where your server is located, your type of computer, timestamp data and the pages of the Websites that you viewed during your visit. Some of this information is gathered through the following technologies:

f) Cookies. In order to improve your user experience we may use cookies. “Cookies” are small pieces of information that are stored by your browser on your computer’s hard drive. Generally, Cookies work by assigning to your computer a unique number that has no meaning outside of the Websites. Our Cookies do not generally contain any personally identifying information. Most web browsers automatically accept Cookies, but you can usually configure your browser to prevent this. Not accepting Cookies may make certain features of the Websites unavailable to you. 

g) IP Address. You can visit many areas of the Websites anonymously without the need to become a registered user. Even in such cases, we may collect IP addresses automatically. An IP Address is a number that is automatically assigned to your computer whenever you begin service with an Internet Service Provider. Each time you access the Websites and each time you request one of our pages, our server logs your IP address. Standing alone, your IP address is not necessarily personally identifiable, but may constitute Personal Information (and will be treated as such by MKP) if linked to your other Personal Information submitted via the Websites.

h) Web Beacons. We may use a variety of other technical methods for tracking purposes, including web beacons. Web beacons are small pieces of data that are embedded in web pages and e-mails. We may use these technical methods in HTML e-mails that we send our users to determine whether they have opened those e-mails and/or clicked on links in those e-mails. The information from use of these technical methods may be collected in a form that is personally identifiable.

Access and Change to or Deletion of Personal Information. As a registered user, you can view and modify the Personal Information you have included in your Member Profile by logging in and accessing your account. Upon your request, we will use commercially reasonable efforts to delete your account and the Personal Information in your Member Profile. However, we reserve the right to maintain a confidential record of your attendance in programs and workshops and your contact information in a separate account which will not be accessible by the general membership. Members who wish to close their account should contact [email protected].

USE AND DISCLOSURE OF PERSONAL INFORMATION.

Use of Personal Information and Non Personal Information. We use Personal Information and Non Personal Information in order to verify your identity for your protection, to communicate with you about your use of the Websites and listserves and to send you information which you request (for example, related to trainings and community events.) We may also use this information to contact you for fundraising purposes or, on rare occasions, to provide you with information we believe will be particularly valuable for our Members. In addition, we may use Personal Information and Non Personal Information to learn more about our community so we can improve our Websites’ features, services, promotions and events. Specific examples of how we may use your information that we collect include, but are not limited to:

i) System Administration. We may use your IP Address and other information discussed above in Section 1.3 for the purposes of system administration, to assist in diagnosing problems with our server, to monitor our system performance and the level of activity on the Websites in general and about specific portions of our Websites and how the traffic on our Websites is apportioned and from where it may come, and to gather broad demographic information about our Websites’ visitors and customers, so we can make it easier and more convenient for you to navigate and use the Websites, and make our Websites more useful and better targeted for you and our community in general.

j) Personalization. We use Cookies and IP Addresses to provide features such as personalization.

k) Notices to Confirm Registered Users. We may use your Personal Information to send one or more emails regarding your registration, including confirmation to verify the accuracy of the Member Profile and instructions regarding how to use the Websites.

l) Contacting Prospective Members. If you are a Prospective Member, we may use your Personal Information to contact you regarding your registration in a New Warrior Training Adventure or other program.

m) Informational and Promotional Emails; Opt-Out Option: We may use your email address to send you emails listing promotions, events and/or services, other items related to our Websites or other marketing and advertising. However, you have the choice to opt-out of receiving such promotional/advertising emails by following the instructions at the bottom of our promotional email. Once we have processed your opt-out request, we will not send you promotional/advertising emails unless you opt back in to receiving such communications directly.

n) Reproduction of Feedback. If you submit Feedback to us, you agree that we may use your Personal Information and such Feedback as permitted under this Privacy Policy, including reproducing the Feedback on the Websites and in our marketing and advertising materials.

o) Contact Information: If you contact us by telephone, email or letter, we may keep a record of your contact information, correspondence or comments. If you report a problem with the Websites, we may collect this information in a file specific to you. In addition, if you provide us Feedback through the Websites, by email or by calling us, we may ask for your name and email address in order to send you a reply. You may contact us at [email protected] to request the removal of this information from our database, subject to section 1.4.

Disclosure of Personal Information.

p) General Rule. Except as otherwise stated in this Privacy Policy, we do not sell, trade, rent or otherwise share your Personal Information collected on the Websites to others.

q) Member Use: Member Profiles submitted by registered users are fully disclosed to other registered users. A registered user’s Member Profile may include the user’s first and last names, email address, phone numbers, address, age, date of birth, occupation, and other information. As a registered user, you can view and modify your Member Profile, to include or exclude any category of information, by logging in and accessing your account.

r) Service Providers. We may disclose your Personal Information to third party service providers who are performing services on our behalf, such as marketing assistance, postal and email delivery, hosting services, customer service, data analysis and payment processing. These third parties may not use your Personal Information other than to provide the services requested by us and will only be permitted to obtain such Personal Information as they require to deliver such services. Furthermore, such services providers are required to maintain the confidentiality of your Personal Information disclosed to them in a manner consistent with this Privacy Policy. We may provide aggregated statistics about our visitors, registered users, sales, traffic patterns, and related website information to third parties. We reserve the right to use or disclose Non Personal Information in any manner.

s) Links to Other Websites. Our Websites may contain links to third party websites to which we have no affiliation. We do not share your Personal Information with those websites and are not responsible for their privacy practices. We suggest you read the privacy policies on those third party websites.

t) Enforcement of Law and/or Terms of Use. From time to time, we may be required by law enforcement or judicial authorities to provide Personal Information to the appropriate governmental authorities. We will disclose Personal Information upon receipt of a court order or subpoena or to cooperate with a law enforcement investigation. We fully cooperate with law enforcement agencies in identifying those who use our products or services for illegal activities. We reserve the right to report to law enforcement agencies any activities that we in good faith believe to be unlawful. Moreover, we may use or release account information and Personal Information when we believe that such release is reasonably necessary to protect the rights, property and safety of our users, others and ourselves.

u) Change in Control. We may transfer your Personal Information to a successor in interest to the Clarity Communications if we are acquired by or merge with another organization. In such event, Clarity Communications will use reasonable efforts to notify you (either by posting notice on the Websites or by email to you at the last known email address) before information about you is transferred and becomes subject to a different privacy policy, provided however, in the event Clarity Communications fails to notify you, your Personal Information will still be transferred but subject to this Privacy Policy.

INFORMATION FOR PERSONS OUTSIDE THE UNITED STATES.

By consenting to this Privacy Policy, you confirm that your knowledge of English (or such other language, if this Privacy Policy is being provided to you by MKP in such other language) is sufficient to understand the terms and conditions set forth in this Privacy Policy. For persons in European Union countries, as used herein, terms such as “Personal Information” refer to “personal data” as defined by the Guidelines 2/2018 on derogations of Article 49 under Regulation 2016/679. We will not collect any personal data from you unless you provide it voluntarily by providing us with your freely given specific and informed consent. You agree that we may transfer your personal data outside the European Union in connection with the purposes stated in this Privacy Policy. Your personal data may be transferred to the United States (and/or other non-EU jurisdictions, as applicable).

INFORMED CONSENT. OPT-IN AND OPT-OUT

Promotional Emails. We may from time to time send you email regarding current promotions, new services, advertising or other marketing, or additions to the Websites. You may “opt out” or unsubscribe from such non-registration-related emails by following the instructions at the bottom of any promotional email.

Informed Consent. All collection of data from public web sites is accompanied by an explicit double-opt-in consent form. 

Withdrawal of Consent. You may withdraw consent for use of your information by opting out from any communication. You may request that your information be deleted from our system by contacting the Data Controller through [email protected]

Control and Processing of Data. Clarity Communications is the Controller of user data submitted to our system. Users may at any time view the information collected by requesting information from the Data Controller at [email protected]. Processing of user data is conducted by Clarity Communications except when being used for advertisement targeting by other service providers. 

Use of Data for Automated Tasks. Clarity Communications will only use data for automated tasks to provide information specifically requested by a user, such as the location of a training program or offering, additional information about products and services, or the web or email address of a local community or local contact. 

Personal Demographic Data. Clarity Communications only collects personal information with explicit consent from the user. This personal information is never sold, transferred, or shared with other entities unless explicitly noted at the time of collection. Personal data may be processed or used in the fulfillment of contracted services by the user. 

SAFEGUARDING YOUR PERSONAL INFORMATION.

Our Security Measures. We use a variety of security measures to protect against unauthorized access to or unauthorized alteration, disclosure or destruction of data. These include internal reviews of our data collection, storage and processing practices and security measures, as well as physical security measures to guard against unauthorized access to systems where we store Personal Information. We restrict access to Personal Information to employees, contractors, and agents who need to know that information in order to operate, develop, or improve our services. Credit card transactions are handled by established third-party banking institutions and process agents. These third-parties directly receive the information they need to verify and authorize your credit card transactions. When collecting credit card information, these third-parties offer secured server transactions that encrypt your information in transit to prevent someone from intercepting it and misusing it. All information collected from you is retained on a secure server. Although we use reasonable efforts to safeguard the security of your Personal Information, transmissions made on or through the internet are vulnerable to attack and cannot be guaranteed to be secure. You hereby acknowledge that Clarity Communications is not responsible for any intercepted information sent via the internet, and you hereby release us from any and all claims arising out of or related to the use of intercepted information in any unauthorized manner.

Protecting Yourself. We make various public forums (such as discussion forums, message boards or news groups) available to our users. When you disclose Personal Information in such public forums, that information can be collected and used by others in various ways, including by sending unsolicited messages. You are solely responsible for any postings you make in public forums on Clarity Communications Websites. You are solely responsible for safeguarding and maintaining the secrecy of your user name, passwords and/or any account information in your possession or control. Please be careful and responsible whenever you are online. The Websites contain links to third parties who may collect information directly from you. Each of the websites linked from the Websites have separate privacy policies and data collection practices, independent of Clarity Communications, and we have no responsibility or liability for these independent policies or actions and are not responsible for the privacy practices or the content of such websites nor do we make any warranties or representations about the contents, products or services offered on such websites or the security of any information you provide to them. You can learn more about internet privacy from government websites such as http://www.ftc.gov/privacy. In addition, it is important to keep us updated with your most current contact information. You may ask us in writing via mail or email at [email protected] to have the information on your account deleted, updated or corrected, subject to Section 1.4; however, because we keep track of past user account activity, you cannot delete information associated with past user activity. Note that we may retain changed or deleted information for archival or other purposes.

GENERAL

Changes To Our Policy. This Privacy Policy is effective with respect to any Personal Information collected on or after the effective date set forth below. Clarity Communications reserves the right to modify or supplement this Privacy Policy at any time. If we make any changes, we will update the Websites and Privacy Policy to include such change and notice thereof. Please review this Privacy Policy often to review any changes that may affect your use of the Websites. Your continued use of the Websites once the revised Privacy Policy has been posted on the Websites affirms your agreement to such changes.

Children, Parental Consent Policy. The Children’s Online Privacy Protection Act imposes certain requirements on websites directed toward children under 13 that collect information on those children, or on websites that know they are collecting Personal Information from children under the age of 13. We want to let you know that it currently is our policy not to collect Personal Information from any person under 13 because children are not permitted to use the Websites or services on the Websites, and we request that children under the age of 13 not submit any Personal Information to us via the Websites. If we learn that we have inadvertently gathered Personal Information from children under 13, we will attempt to notify such child’s parent or guardian and erase such information from our records.
